Loyal Techs, LLC (“us” or “we”) is committed to respecting the privacy of users of our Application, Loyal Techs (the “Application”) and services provided by us through the Application and our website at https://www.loyaltechs.com/ (collectively, the “Services”). We (or our subcontractors) host the Application to connect you to IT professionals that have entered into an agreement with us (a “Tech”). Once you book a Tech through the Services, the responding Tech may be referred to as “your Tech.” We created this Privacy Policy (“Privacy Policy”) to tell you how we protect, collect, use, disclose and store the information collected through the Services.

 

By downloading, accessing, or using the Application or Services, and/or by registering with us or providing information to us in connection with the Application or Services, you accept the practices and policies outlined in this Privacy Policy, and you hereby consent that we will collect, use, and share your information as set forth in this Privacy Policy. If you are registering an account or using the Services on behalf of an individual or entity other than yourself, you represent that you are authorized by such individual or entity to accept this Privacy Policy on such individual's or entity's behalf.

 

Your use of the Application is also subject to our Terms of Use, which are available here https://www.loyaltechs.com/terms.

 

You understand that we may change this Privacy Policy at any time and any changes to this Privacy Policy will become effective when we make the revised Privacy Policy available through the Application. We will update the “Most Recent Revisions” date at the bottom of this Privacy Policy if we make any such changes to this Privacy Policy. Your use of the Application or the submission of any information in connection with the Application following any change means that you accept the revised Privacy Policy.


 

  1. PERSONAL INFORMATION

 

    1. Personal Information We May Collect

 

For the purposes of this Privacy Policy, “Personal Information” means information that can be used to uniquely identify you, such as your name, telephone number, address, and email address.

In order for you to use the Services, we may require you to create an account and provide us with information that identifies you as an individual (“Personal Information”). We and our service providers may request and/or collect Personal Information from you that includes, but is not limited to: (1) your name and your contact data (such as your email address, phone number, billing and physical addresses, and your Application login and password); (2) demographic data (such as your name, date of birth and your zip code); (3) payment information (such as your credit or debit card number); and (4) confirmation that your Tech provided services to you, that you provide through the Application. If you communicate with us by through any method, for example, email or letter, any information provided in such communication may be collected as Personal Information.

 

If you do not want your Personal Information collected in this manner, please do not create an Account or book a Tech through the Services.

 

The Services may also ask you to provide other information such as a description of your particular service need and photos of the technical issue (e.g., your technical issue, etc.). This information, including your Personal Information, may be shared with your Tech that will be providing you with the service(s).

In order to provide the Services and connect you with your Tech, we will also collect precise information about the location of your mobile device, with your consent. Please see below under “How We Collect Non-Personal Information” for additional information about our collection of location information.

 

We may also retain any messages you send through the Service, and may collect information you post to the Service such as Tech ratings and comments. We use this information to operate, maintain, and provide to you the features and functionality of the Service.


 

    1. Information You Provide Us as a Tech

 

If you create a Tech account with us, you have the opportunity to provide additional information (“Business Profile”) such as your name, logo, photograph of yourself, credentials and qualifications, licenses, year of business establishment, as well as links to your personal web site, if you have one. You will need to provide your financial information for purposes of processing a transaction on or through the Service. We may supplement or modify the Business Profile to conform to our policies or to add information from your website, materials that you supply to us, or publicly available sources. When you respond to a service request, any or all of the Business Profile can be displayed to the individual making such service request. For the purpose of this Privacy Policy, you agree that all information in your Business Profile will constitute Personal Information.

 

    1. How We May Use Personal Information

 

We and our third-party service providers may use your Personal Information to:

 

  • Respond to your inquiries and fulfill your requests, such as providing a Tech with your location information or to establish a telephone or web conference;

 

  • send you administrative information, including information regarding the Application, and changes to our Terms of Use, conditions and policies;

 

  • schedule and provide services related to the scheduling of appointments, for example, to send to you appointment confirmation; communicate with you and your Techs regarding appointments and related services provided by your Tech; obtain or facilitate payments for appointments and related services provided by your Tech and send you payment receipts; and provide you with related customer service;

 

  • confirm that services you request were provided to you by your Techs;

 

  • send you marketing communications that we believe may be of interest to you;

 

  • contact you directly by phone call, text message, or email, about your account with us and the Services you have/will receive;

 

  • personalize your experience on the Application by presenting products and offers tailored to you;

 

  • further our business purposes, such as quality assessment, data analysis, audits, developing new products, enhancing the Application, improving our Services, identifying usage trends, developing tools which help you assess the performance, competence and qualifications of the Techs and determining the effectiveness of our promotional campaigns; and

 

  • act as we believe to be necessary or appropriate: (a) under applicable law; (b) to comply with legal process; (c) to respond to requests from public or government authorities; (d) to enforce our Terms of Use; (e) to protect our operations or those of any of our affiliates; (f) to protect our rights, privacy, safety or property, or that of our affiliates, you or others; or (g) to allow us to pursue available remedies or limit the damages that we may sustain.

 

  • As a Tech, we will share your location, Business Profile, your photograph, “star rating”, first and last name, and phone number with individuals requesting a service.

 

  • Completed services.  As a user of the Services or as Tech, we may publish to our website, Application, or other Services your first name, last initial, description of Service completed, Facebook picture, ZIP code and date.

Our use of your Personal Information may also be subject to certain restrictions set forth in an agreement between us and a Tech.

 

    1. How Personal Information May Be Disclosed

 

Your Personal Information may be disclosed to:

 

  • our third-party service providers that provide services such as hosting of the Application, data analysis, IT services and infrastructure, customer service, email delivery, auditing and other similar services;

 

  • Techs, including your Techs, to schedule and fulfill appointments and provide services and confirm those services were delivered to you;

 

  • As a Tech, we will share your location, Business Profile, your photograph, “star rating”, first and last name, and phone number with individuals requesting a service.

 

  • our affiliates, for the purposes described for Personal Information in this Privacy Policy, including marketing purposes relating to their products and services;

 

  • third parties, to permit them to send marketing communications to you regarding our products or services or the services of your Techs;

 

  • a third party in the event of any reorganization, merger, sale, joint venture, assignment, transfer, liquidation or other disposition of all or any portion of our business, assets or stock (including in connection with any bankruptcy or similar proceeding); and

 

  • a third party as we believe to be necessary or appropriate: (a) under applicable law; (b) to comply with legal process; (c) to respond to requests from public or government authorities; (d) to enforce the Terms of Use; (e) to protect our operations or those of any of our affiliates; (f) to protect our rights, privacy, safety or property, or that of our affiliates, you or others; or (g) to allow us to pursue available remedies or limit the damages that we may sustain.

 

Our disclosure of your Personal Information may also be subject to certain restrictions set forth in an agreement between us and your Tech.


 

  1. NON-PERSONAL INFORMATION

 

    1. Non-Personal Information We May Collect

 

“Non-Personal Information” is any information that does not reveal your specific identity. The types of Non-Personal Information that we collect are described in more detail below under “How We Collect Non-Personal Information.”

 

    1. How We Collect Non-Personal Information

 

We and our third-party service providers may collect Non-Personal Information in a variety of ways, including:

 

  • Physical Location: If you give us your consent, we may collect information about the physical location of your device, for example, using your device’s GPS functionality. We may use such information to provide you with personalized location-based services and content (for example, information regarding local Techs). We may also share your device’s physical location, combined with information about what advertisements you viewed and other information we collect, with our marketing partners to enable them to provide you with personalized content and to study the effectiveness of advertising campaigns. You may be permitted to allow or deny such uses and/or sharing of your device’s location, but if you choose to deny such uses and/or sharing, we and/or our marketing partners may not be able to provide you with the applicable personalized services and content.

 

  • From you: We may collect Non-Personal Information such as your general geographic location, as well as other information, such as your preferred means of communication, when you voluntarily provide such information to us. Unless combined with Personal Information, this information does not personally identify you or any other user of the Application.

 

  • By de-identifying information: Aggregated and anonymous Personal Information is information that is derived from Personal Information that does not personally identify you or any other user of the Application. For example, we may aggregate Personal Information to calculate the percentage of our users who have a particular telephone area code.

 

    1. Information We Collect Automatically

 

Whenever you visit or interact with the Services, we may use a variety of technologies that automatically or passively collect information about how the website is accessed and used ("Usage Information"). Usage Information is a type of Non-Personal Information.  Usage Information may include, in part, browser type, operating system, the page served, the time, the preceding and following page views, and your location. This statistical data provides us with information about the use of the website, such as how many visitors visit a specific page on the website, how long they stay on that page, and which hyperlinks, if any, they "click" on. This information helps us keep our website fresh and interesting to our visitors and tailor content to a visitor's interests. Usage Information is generally non-identifying, but if we associate it with you as a specific and identifiable person, we will treat that information as Personal Information.

 

We and our third-party service providers may automatically collect Non-Personal Information in a variety of ways, including:

 

  • Through your device: Certain information is collected automatically through your device, such as your operating system name and version, device manufacturer and model, device identifier, language, the name and version of the software application you are using. We use this information to ensure that the Application functions properly and to understand usage of the Application.

 

  • Through server log files: Your “IP Address” is a number that is automatically assigned to the device that you are using by your Internet Service Tech (ISP). An IP Address is identified and logged automatically in our server log files whenever a user uses the Services, along with the time of the use and the pages visited within the Services. We use IP Addresses for purposes such as helping to calculate Application usage levels, diagnose server problems and administer the Application.

 

The technologies used on the Site to collect Usage Information, including Device Identifiers, may include:

 

  • Cookies. Cookies are data files placed on a device when it is used to visit a website. We, or our third-party advertising service providers, may place cookies or similar files on your device for security purposes, to facilitate site navigation and to personalize your experience while visiting our website. Cookies allow us to collect technical and navigational information, such as browser type, time spent on our website and pages visited. Cookies allow us to select which of our offers are most likely to appeal to you and display them while you are on the Site and other websites. We also use cookies that enable our Services to serve advertisements of our products and services, including special offers, when you visit other websites (these cookies shall be referred to as the "Advertising Cookies"). Please note that we do not link the information in the Advertising Cookies or any other cookie to your personal information. Moreover, we do not obtain, store or maintain any personally identifiable information about you through our use of cookies (either the session cookies or the Advertising Cookies).

 

You always have the option of disabling cookies using your browser preferences. However, please be aware that some features of the Services may not function properly or may be slower if you refuse cookies.

 

  • Pixel tags. A pixel tag is a transparent graphic image, sometimes called a web beacon, clear GIFs or tracking beacon, placed on a web page or in an email, which indicates that a page or email has been viewed. In addition, a pixel tag may tell your browser to get content from another server.

 

  • We use Google Analytics to better understand how visitors interact with our website. This service provides non-personally identifiable data including but not limited to data on where visitors came from, what actions they took on our site and where visitors went when they left our site.

    1. How We Use and Disclose Non-Personal Information

 

Because Non-Personal Information does not personally identify you, you agree that we may use and disclose Non-Personal Information for any purpose. In some instances, we may combine Non-Personal Information with Personal Information (such as combining your zip code with your name). If we combine any Non-Personal Information with Personal Information, the combined information will be treated by us as Personal Information as long as it is so combined.

 

  1. THIRD PARTIES

 

This Privacy Policy does not address, and we are not responsible for, the privacy, information or other practices of any third parties, including Techs, the manufacturer of your mobile device, and any other third party mobile application or website to which the Application may contain a link. We encourage you to review the privacy practices of each Tech who provides you with services and the privacy policies of each website and application you visit and use.

 

  1. SECURITY

 

We seek to use reasonable physical, technical and administrative measures to protect Personal Information under our control. Unfortunately, no data transmission over the Internet or data storage system is 100% secure, and therefore we cannot guarantee against all potential security breaches.

 

If you have reason to believe that your interaction with us is no longer secure (for example, if you feel that the security of any account you might have with us has been compromised), please immediately notify us of the problem by contacting us in accordance with the "Contacting Us" section below.

 

  1. CHOICES AND ACCESS

 

Your choices regarding our use and disclosure of your Personal Information

We give you choices regarding our use and disclosure of your Personal Information for marketing purposes. Specifically, you may opt-out from:

 

  • Receiving marketing-related emails from us based upon your Personal Information: If you no longer want to receive marketing-related emails from us on a going-forward basis, you may opt-out of receiving such marketing related emails by sending an email to info@loyaltechs.com.

 

  • Our sharing of your Personal Information with affiliates for their marketing purposes: If you would prefer that we do not share your Personal Information on a going-forward basis with our affiliates for their marketing purposes, you may opt-out of such sharing by sending an email to info@loyaltechs.com.

 

  • After receiving your request, we will try to comply with your request(s) as soon as reasonably practicable. Please note that if you opt-out as described above, we will not be able to remove your Personal Information from the databases of our affiliates or third party service providers with which we have already shared such information (i.e., to which we have already provided such information as of the date that we implement your opt-out request).

 

  • Please note that if you do opt-out of receiving marketing-related messages from us, we may still send administrative messages to you; you cannot opt-out from receiving administrative messages.

 

    1. How You Can Access or Update Your Personal Information

 

If you would like to review or update your Personal Information that has been previously provided to us, you may do so by logging into your account within the Application. We will try to comply with your request to update your Personal Information as soon as reasonably practicable. We are not responsible for changing information from the databases of third parties with whom we have already shared your Personal Information.

 

  1. USE OF APPLICATION BY MINORS

 

The Application is not directed to individuals under the age of 13, and we do not knowingly collect Personal Information from users under the age of 13. If we learn that we have received any information from an individual under the age of 13, we will use that information only to respond directly to that child (or a parent, legal guardian or personal representative) to inform him or her that he or she cannot use the Services and subsequently we will delete that information from our own servers. However, if you are a parent, legal guardian or personal representative of a minor child, you may, in compliance with the Terms of Use, use the Services on behalf of such minor child. Any information that you provide us while using the Services on behalf of your minor child will be treated as Personal Information as otherwise provided herein.

 

  1. YOUR CALIFORNIA PRIVACY RIGHTS

California Civil Code sections 1798-83 – 1798-84 give residents the right to ask us for a notice describing the categories of Personal Information we share with affiliated companies at: info@loyaltechs.com.of third parties for their direct marketing purposes. The notice will identify the categories of information shared and will include a list of the third parties and affiliates with which it has been shared. Please allow 30 days for a response. If you are a California resident and would like a copy of this notice, please submit a written request to us

We do not currently respond to web browser “do not track” signals or other mechanisms that provide a method to opt out of the collection of information across the networks of websites and online services in which we participate.
